Greetings from Onyul's Chairman

As it always has, Onyul has gave its best for the enhancement of public interest of our society in 2022.

We have hired additional public interest attorneys, thereby expanding our purview and activities into areas including but not limited to women's and children's rights; the rights of those with disabilities; and the rights of the impoverished. Celebrating the 10th anniversary of the implementation of the Adult Guardianship System, Onyul has published the book which is the gathering and culmination of the many endeavors of the past decade and has also engaged in policy improvement activities in the area through activities such as hosting the first seminar on Adult Guardianship. Also, Onyul has proactively participated in pro bono public interest litigations including but not limited to the litigation in which the Constitutional Court of Korea ruled that "Article 69(1) of the State Public Officials Act which mandates the immediate dismissal of public servants who have been ruled to be in need of adult guardianship is unconstitutional" and moreover, continued to participate in actual legal aid of the under-privileged as professional guardians. Next, with the goal of achieving synergy among non-profit organizations and law practitioners, Onyul has also started a secondment project dispatching its lawyers to non-profit organizations and expanded its scope of legal aid for non-profit start-ups to accommodate social and economic institutions including the Social Solidarity Bank and the Seocho Social Economy Integrated Support Center. Onyul also worked on research projects to improve the Korean system for North Korean defectors and provided scholarships to facilitate the employment of North Korean defector women and North Korean youth education. Overall, including but not limited to the foregoing, Yulchon and Onyul did our best at what we are most talented at and worked diligently to fulfill the societal needs of our society. Through our endeavors we believe that the world has become a better place than it was yesterday.

Despite the end of the seemingly never ending Covid 19 pandemic, the world is becoming more and more complicated and complex which implies that the scope of public interest and human rights needs will also skyrocket. Living in such a time of rapid and fundamental change, Onyul and Yulchon believe that we have work to do. As we always have, Yulchon and Onyul will do our best in the upcoming year to make the world a better place than it was yesterday.

Greetings from the Yulchon Public Interest Committee Chairman

Yulchon and Onyul, side by side and hand in hand are working diligently to enhance the public interests of our society. Even though 2022 was a difficult time recovering from the Covid19 pandemic, all members of Yulchon who share the vision of 'a community of top professionals who pursue innovation on the path of righteousness' have done their best.

Last year, Yulchon has worked slowly but consistently to cultivate public mindedness in our members who now surpass 1,000 in number. Externally we provided consulting services regarding ESG and internally, we had a variety of programs regarding public interest doing our best to internalize ESG practices ourselves. Despite the uncertainty that the financial instability and real economic crisis impose, Yulchon, as it has always been, will do our best to break through this time of crisis through collaboration, innovative thinking, and effective innovation. Moreover, Yulchon will not neglect the warm heart and the public obligation that we owe to the public as lawyering professionals and thereby will do our best to fulfill it.

Social Integration of People with Mental Disabilities

Improvement of Decision-making Support and The Adult Guardianship System

Presentation at the Academic Conference of the Japan Adult Guardianship Law Association

Attorney Kwang-yeol Bae was invited to present at the academic conference of the Japan Adult Guardianship Law Association on October 8th, 2022. The presentation was titled "Operational Practices and Challenges of Specific Guardianship in Korea." The seminar was attended by over 200 experts in the field of guardianship, including Japanese attorneys, legal scriveners, social workers, and scholars, both online and offline.

Public Interest Guardianship Litigation
  • Court ruled Article 69 Subparagraph 1 of the State Public Officials Act which mandated the immediate dismissal of public servants ruled to need adult guardianship as unconstitutional(Constitutional Court Decision 2020Hun-Ga8, announced on December 22, 2022.) : Onyul with law firm Jipyong and Duroo (incorporated association for public interest law) co-represented a party pleading the court to rule as unconstitutional, Article 69 Subparagraph 1 of the State Public Officials Act which mandates the immediate dismissal of public servants who have been ruled to need adult guardianship. After a public hearing in September 2021, the Constitutional Court of Korea ruled that the provision in question violated the freedom of occupation and was unconstitutional. This case is significant as it is the first to confirm the unconstitutionality of the 'disqualification clause,' which deprives one of their qualifications and profession due to guardianship and marks a major step forward. Onyul plans to carry out legislative efforts to abolish disqualification clauses, including the one in the Social Welfare Service Act, and has appointed a representative for constitutional petition (2021Hunma1288) to this effect.

At present, 14 years have passed since the enactment of the Act on The Prohibition Of Discrimination against Persons with Disabilities, Remedy Against Infringement Of Their Rights, ETC. To enhance the effectiveness of the law through reflecting changing social environments, expanding remedies for rights violations, and expanding the definition of disability and the scope of rights, we are participating in meetings of the Task Force for the Comprehensive Amendment of the Act on the Prohibition of Discrimination against Persons with Disabilities.

  • Believing that legal support for nonprofit organizations to create an environment where they can better carry out their public service activities is in line with promoting the welfare of society, Onyul has established a system where our public interest lawyers can work within the organization and provide full-time support beyond the existing limited legal support to provide more effective support.
  • In particular, starting in the second half of 2022, we partnered with World Vision to help the organization organize its legal practice and carry out its unique work to better support the world's most vulnerable children, families, and communities.

Legal Support for Nonprofit Startups
  • In November 2020, ONYUL signed an MOU with the Daum Foundation to provide legal services and improve the nonprofit system as part of the creation of a back office for nonprofit startups. Onyul's attorney, Kyu-hae Jeon, visits the nonprofit startup office space "Dongraka" every week to provide legal advice and legal education to the nonprofit startups incubated by the Next Generation Foundation.

Legal support to a local NGO in Vietnam

As part of its pro bono activities, the Yulchon Ho Chi Minh office provided legal advice to the Korea NGO Council for Overseas Development Cooperation (KCOC)'s "NGO Accounting and Compliance Program" being conducted in Hanoi, Vietnam, for the domestic NGO, Korea Food for the Hungry International (KFHI) Vietnam Branch. Yulchon's Ho Chi Minh City office served as the legal advisor for the program, which aims to proactively address the various legal risks faced by international development cooperation NGOs and promote. Starting with this activity, Yulchon plans to actively participate in pro bono activities in our overseas offices.

Signed an MOU with the Social Solidarity Bank(Together Making a Better World) and Provided Legal Support

In July 2022, Yulchon and Onyul signed a business agreement with the Social Solidarity Bank to provide legal advice to social entrepreneurs, budding entrepreneurs, and the financially excluded. In 2022, as our first legal support case, we were able to help a young person who grew up in a nursery and was being supported by the Social Solidarity Bank so that that young person could become self-reliant. In an unfortunate situation where the young person, who had been living in a nursery for a long time due to his parents' divorce, was left with the debts of his father, who had died suddenly, Onyul and the Social Solidarity Bank not only helped him go through the inheritance renunciation process, but also provided legal advice, including guiding him through the process of responding to a lawsuit against the real estate where his father lived.

Signed an MOU with the Seocho Social Economy Integrated Support Center in November 2022.

In November 2022, Yulchon and Onyul signed a three-way MOU with the Seocho-gu Social Economy Integrated Support Center for mutual cooperation to revitalize the social economy and practice ESG management. Support for Settlement of North Korean Defectors

Research on legal framework related to North Korean defectors

Participated in the research project for revising the unrealistic aspects of the North Korean Defectors Law, jointly organized by the Korean Bar Association and the Human Rights Foundation of the Korean Bar Association.

Attorney Kyu-hae Jeon of Onyul is the secretary of the Legal Support Subcommittee for North Korean Defectors of the Korean Bar Association's North Korean Defector Legal Support Committee and is participating in the Research Project to Revise the North Korean Defectors Law. The project, co-organized by the Korean Bar Association and the Korean Bar Association Human Rights Foundation, aims to improve the effectiveness of the resettlement support system for North Korean defectors by revising the North Korean Defectors Law, which is not in line with reality.

Efforts to Improve the Adoption System and Promote the Rights of Overseas Adoptees

In 2022, we provided consulting services for the revision of the Act on Special Cases Concerning Adoption and the establishment of the International Adoption Act to ensure the best interests and effective protection of children under the child protection system. We also supported the Adoption Project intended to enhance the understanding of the subject matter among child protection officers in each local government through lectures and individual consultations on the adoption system reform, so that the Adoption Project could be settled within the child protection system.

Assisting the impoverished

Providing Assistance in Case of The Death of Those with No Connections

As the number of single-person households in Korea has increased to 31.7% of all households in 2020, the number of people who die alone, cut off from the people around them, is also increasing, resulting in 'lonely deaths'. Due to this change in social phenomenon, the number of deaths of those with no connections, with no heirs under civil law is also increasing. In response, Onyul has been conducting the following support activities.

  • Participated in the development of the 'Guide to Handling Inheritance Property Upon Death of a Person with No Known Heirs (Revised Edition)' published by the Seoul Social Welfare Public Interest Law Center.
  • Represented a person with no connections in having appointed an administrator for the inheritance property.
  • Provided legal assistance for the last property disposition of an impoverished person with no connections.
Provided Support for Establishing Personal Identification Documents for Individuals with Mental Disabilities

Onyul provided legal support for the adjudication of the birth registration and issuance of resident registration numbers for three severe intellectual disability unregistered individuals living in Changwon, Gyeongsangnam-do in 2022, following the previous support for a similar case in Yeongju, Gyeongsangbuk-do in 2021. Our efforts aim to help these individuals become full members of society with family relationships and legal identification numbers.

Legal Support for the Impoverished

Participated in Regular Meetings for Joint Action to Effectively Enforce the National Basic Living Security Act

Onyul is working with related organizations to address the blind spots and poverty issues arising from the level and selection criteria of the Basic Livelihood Security System, and is engaged in activities to ensure rights, advocate for legal reforms, and provide counseling to make the basic livelihood security system a proper welfare system.

We participated in the Homeless Support Joint Planning Team formed every year around Winter Solstice Day, mourning those who have died in poor living conditions and working to improve homeless rights and welfare systems.

Yulchon Center for Legal Theory Research

Yulchon established the Yulchon Legal Theory Research Center in 2015 to promote domestic basic legal research, and is operating it in cooperation with the Seoul National University Law School. In 2022, Yulchon continued various activities to promote domestic basic legal research, including awarding the Yulchon Basic Law Paper Award, launching a basic law research journal, hosting regular colloquiums, and supporting basic law research groups.

Yulchon invited three lecturers with disabilities (Lee Jin-young, Lee Chang-hoon, and Lee Won-joon) to give an online and offline special lecture for all employees with the keyword 'Refreshing Disability Awareness'. Yulchon aims to create a corporate culture where employees with disabilities and employees without disabilities can understand and communicate with each other.


'Movie In Yulchon,' a Public Interest Movie Screening Event

Yulchon hosts Movie-in-Yulchon, a public service movie screening event that aims to awaken employees' sense of public interest and spread social values. In 2022, the program provided an opportunity to rethink disability, race, and gender through films such as Children in Poland, The Lawyer Who Changed the World, and Untouchable: The Friendship of the 1%, and organized various events such as a talk show with director Chu Sang-mi, public interest quiz games, and board games to create a place for learning and exchange among employees.

Fundraising Events for Public Interest

Social Enterprise Invitational Warmth Bazaar

Yulchon organized a warmth sharing bazaar for social enterprises to provide opportunities for social enterprises to come out to the public, and to make the company space a place of culture where employees can interact and enjoy each other, and donated 10 million won to World Vision to support refugees in Ukraine.


Participated in the Autism Race and Blind Mingle Marathon

Yulchon participated in the Autism Race, a donation marathon for the independence of people with autism, and the Blind Mingle Marathon to raise awareness for the blind. Through the active participation of our employees, we were able to deliver a total of KRW 4 million in donations.


Santa in Yulchon

Yulchon held a donation event, "Santa in Yulchon," to help the socially vulnerable. Yulchon employees actively participated in the donation event to coincide with the Christmas season, and the 20 million won collected on the day was donated to Donggwangwon, a childcare center, to build a low-temperature warehouse.

Yulchon and Onyul visit the Claret Center for Migrants in Bucheon on the fourth Saturday of every month to carry out volunteer activities for socially vulnerable elderly people.


Dukum Dukum Day

Yulchon and Onyul visit the Claret Center for Migrants in Bucheon on the fourth Saturday of every month to carry out volunteer activities for socially vulnerable elderly people. In addition, on the second Friday of every month, instead of working in the afternoon, employees participate in voluntary activities by visiting the institutions of their choice, through the 'Dukum Dukum Day' voluntary service program held on weekdays.

An Introduction to Onyul

Onyul is a public interest organization established by Yulchon on March 3rd, 2014. Alongside Yulchon, Onyul strives to establish social integration for the mentally disabled, create an innovative non-profit ecosystem, support the settlement of North Korean refugees, spread social values through education and fulfill the social responsibility of law firms.
